In my attempt to replicate, I performed the following steps:
1. Created a new database file with a single container field
2. Placed the container field on a layout in the classic theme with the default fill "none"
3. Placed the container field on a themed layout and changed the field's fill to "none"
While in Edit Layout, I am able to drag and move the fill "none" container field regardless of the theme.
All tests were performed with FileMaker Pro 12.0v4 and then FileMaker Pro 12.0v5 on an iMac with Mac OS X 10.8.5 Mountain Lion.
Perhaps, I am missing a step to replicate?
I just realized that "Show sample data" must be enabled for this behavior to manifest itself. If this option is unchecked then the container field with fill "none" can be moved, but cannot if it is enabled.

I am able to replicate with View > Show > Sample data checked. This was previously reported by another user in the following thread:
Testing and Development was also able to reproduce and confirmed the issue. I have no additional information at this time.
I find that I can move the field in Windows 7 if I carefully click on and drag the precise border of the field, which makes this behavior very similar to the bug report found here:
