I have no issues using Get ( FoundCount ) in the hide condition of an object. Can you give more details - perhaps a screen shot of the hide condition?
What is the Formula for 'Hide' condition?
Maybe any addition like
OR isEmpty (xy)
(Foundset = 0)

Formulas are correct.
Obviously, if there's no record (Foundset = 0), even graphic- OR text object don't get displayed within Body-Part.
Be aware that this is for Body-Part.
Your label are displayed when placed in Header- OR Footer-Part!
Maybe this facts will lead to a work around.

So it is an expected behavior in list view.
I can understand how this can be annoying, but as efficientbizz points out, it really has nothing to do with hide conditions, and I think it's an intentional design choice/feature, not a bug.
Unlike in Form View, no layout objects are rendered in the Body Part in List view when no records are found. This goes for fields, buttons, whatever, irrespective of any hide conditions.
Apart from placing the button in another part, you can also consider adding script triggers that ensure that you switch to Find mode when no records are found - that won't always be a good choice, but at least the button will show up "in the right place". Another option is automatically creating a record that's not committed, and then revert it if the user doesn't actually choose to create a new record - also not without complications, but doable in some cases.
