Unless they changed something in recent versions, script errors from actions that attempt to create a new file cannot be suppressed by set error capture anyway.
That error message usually shows up if the file you're trying to create already exists and is open or your file path is incorrect.
When I use a script where the path is deliberately invalid, I get an error code of 800.

Also, you're correct about error capture not suppressing the error message.
It also can occur if the windows permissions for the folder are not set right.
